The ASB Case Review
What is an ASB Case Review?
The ASB Case Review gives people and communities the right to ask for a formal review if they feel not enough has been done about the anti-social behaviour they reported.
It brings together agencies like the council, police, housing providers, and health teams to review the case and look for any missed opportunities or further action.
The aim is not to place blame, but to find solutions.
When to request an ASB Case Review
You can request an ASB Case Review if the following apply:
- You have reported three separate and specific incidents of ASB about the same issue in the past six months.
- Each incident was reported within one month of it occurring.
- You feel insufficient action has been taken.
Another person can also request an ASB Case Review on your behalf with your consent.
If the criteria are not met but there are signs of vulnerability or serious harm (like hate-related incidents*, exploitation or serious violence), we may still accept the review.
*Hate-related means hosility linked to specific personal attributes that are protected under the Equality Act 2010 such as age, disability, gender reassignment (transgender identity), race, religion, sex, or sexual orientation.
What is not an ASB Case Review?
The Case Review will assess if there are any other actions that could be used to find new, fair and equitable solutions.
Therefore, this process will not address nor offer feedback on:
- Communication regularity and content
- Individual staff conduct, care and ability
- Service quality and provision
- Whether an organisation is correctly following its own policy
- Personal satisfaction
These aspects are routinely dealt with through other processes, but should you have concerns over these areas they would initially need to go through the formal complaints process of the organisation involved.
How to make a complaint to Sandwell Council
Complaints about another organisation’s service should be made directly to that organisation. The council does not process complaints about other organisations.
What happens after you request an ASB Case Review?
- We will confirm that your request has been received
- We may contact you to discuss the case in more detail
- ASB compliance officers will assess the case against criteria in line with policy
- You will be told whether your application meets the criteria for a Case Review
- If your application does not meet criteria, you will receive a written explanation and next steps
- If criteria are met, relevant organisations will form a review panel for the case
- After the panel meets you will be informed of the outcome and any next steps
