Examination of the Draft Charging Schedule

Sandwell Council submitted the Community Infrastructure Levy Draft Charging Schedule to the Planning Inspectorate on 24 July 2014 in accordance with Part 11 of the Planning Act 2008 (as amended) and Regulation 19 of the Community Infrastructure Levy regulations 2010 (as amended).

The Examiners final report was received on 16th December 2015 and recommended that, subject to modifications, that the Charging Schedule be approved.

Submission of the Community Infrastructure Levy (CIL) Draft Charging Schedule (July 2014)

Sandwell Council submitted its CIL Draft Charging Schedule to the Planning Inspectorate for public examination in accordance with Section 212 of the Planning Act 2008 (as amended) and Regulation 19 of the Community Infrastructure Levy Regulations 2010 (as amended).

Indicative timetable for the Introduction of CIL

The following is an indicative timetable for the introduction of CIL in Sandwell MBC:

• Submission of Draft Charging Schedule and associated documents to Planning Inspector - 24th July 2014
• Anticipated Examination in Public hearing - week commencing 6th October 2014
• Anticipated receipt of Planning Inspector report - December 2014
• Anticipated adoption of CIL Charging Schedule - April 2015

Consultation on Draft Charging Schedule (2013, 2014) and Preliminary Draft Charging Schedule (Now Closed)

Following responses received to the 2013 Draft Charging Schedule Publication consultation, it was decided to refresh the Viability Appraisal.  Consultants were appointed and a revised 2014 Draft Charging Schedule; Viability Appraisal and an Infrastructure Delivery Programme  were produced.

They were published for consultation on 17 April 2014, the consultation has now closed and a summary of the responses received has been produced.

Consultation on the 2013 Draft Charging Schedule (with appendices) Viability Appraisal and Infrastructure Delivery Programme ended on 21 October 2013.  Responses to the consultation were received and an initial response was produced.

Previously, consultants Aspinall Verdi carried out an exercise to examine whether the introduction of a CIL charge would affect the viability of development. Within this context a preliminary Draft Charging Schedule was produced. 

Consultation on the preliminary Draft Charging Schedule ended in March 2013.  Responses to the consultation were received and a Consultation Report has been produced.

The proposed charges were established through the use of appropriate available evidence including:

• The Black Country Core Strategy
• The Infrastructure Delivery Programme
• The Viability Appraisal 2013 and 2014.
