Site Allocations and Delivery Development Plan Document
Following the councils resolution to adopt the Sandwell Site Allocations and Delivery DPD and West Bromwich Area Action Plan on 4 December 2012 there is a legal challenge period.
Any person aggrieved by the above documents may make an application to the High Court under Section 113 of the Planning and Compulsary Purchase Act 2004 on the grounds that:
- the document is not within the appropriate powers
- and or that a procedural requirement has not been complied with.
Any application to the High Court must be made no later than seven weeks from 4 December 2012.
The Site Allocations and Delivery Development Plan Document will identify sufficient sites and areas to meet the Borough's housing and employment needs, and will protect the Borough's historic, built and green infrastructure.

Please note that with immediate effect (Jan 2022) that the Council will be implementing the requirement for First Homes in line the National Planning Policy Framework (NPPF). For further information please read the Black Country Authorities First Homes Interim Position Statement.
Following on from the Hearing on 28 and 29 February 2012 the Inspector Mr Crysell has now concluded his Examination into the Site Allocations and Delivery Development Plan Document (SADDPD). The Planning Inspectorate has now issued the Inspectors Report to the Council which concludes that, subject to the inclusion of Main Modifications, the plan has been found to be 'Sound'.
It is the intention of the Local Authority to now proceed with the Adoption of the SADDPD, scheduled to be December 2012. A copy of the Inspectors Report can be viewed by accessing the link below.
The Government published the National Planning Policy Framework (The Framework) and Planning Policy for Traveller Sites in March 2012. Consultation on how these affected the Site Allocations and Delivery DPD ended on Monday 14 May 2012. Comments received can be viewed on the Examinations page.
The Site Allocations and Delivery Development Plan Document (SAD DPD) was submitted to the Secretary of State on 31 October 2011. An Examination took place on Tuesday 28 and Wednesday 29 February 2012. Links and associated documents can be found below.
Consultation on main modifications
The Inspector, Mr Crysell, proposed a number of main modifications to the Sandwell Site Allocations and Delivery Development Plan Document (DPD) and West Bromwich AAP following the recent examinations hearing sessions. These were changes he considered necessary to make the plans sound. Consultation on additional modifications
Sandwell Council published a number of additional modifications to the Sandwell Site Allocations and Delivery DPD and West Bromwich AAP. These are minor changes which have been made in response to earlier representations and to correct factual errors and mistakes, or clarify points which arose during the Examination and are for information only.
The council invited all parties who had made submissions on either of the above plans to write in and let them know their views on the additional modifications by 26 June 2012. Please note that none of these modifications affect the soundness of the plans and comments received will not be passed onto the Inspector.
