This page records new premises licence applications that have been received and may be subject of representation or comment.

Important notice

The date shown for representation against each entry is the date by which a responsible authority or any other person may make representations in respect of the application.

Representations, which must be about the impact of the grant upon the licensing objectives, must be made in writing.

It is an offence knowingly or recklessly to make a false statement in connection with a licence application. The maximum fine on summary conviction is £5,000.

Applications may be inspected at the offices of licensing section which are situated at General Licensing Team, Sandwell Council House, Freeth Street, Oldbury, B69 3DE by prior appointment during office hours Monday to Friday. Arrangements for inspection can be made by emailing licensing_team@sandwell.gov.uk

Applications to review a current premises licence

Top Tak, 74 - 76 Cape Hill, Smethwick, B66 4PB

An application for review has been made by the Trading Standards department at Sandwell Metropolitan Borough Council.

Trading Standards conducted an inspection on 10 August 2021 and found some illicit alcohol and tobacco concealed at the premises. All seized goods were found to be either counterfeit or duty evaded. It is an offence under Section 144 of the Licensing Act 2003 to keep any goods on a licensed premises that have been imported without payment of duty.

The Premises undermines the following licensing objective of:

The prevention of crime and disorder.

The application for a review is being made by Environmental Health at Sandwell Metropolitan Borough Council for the Regis.

Environmental Health have received complaints relating to noise nuisance caused by musical entertainment.

A noise Abatement Notice under Section 80 of the Environmental Protection Act 1990 was served.

The noise abatement notice has been contravened and complaints have continued.

Premises undermines the licensing objective of Prevention of Public Nuisance.
