What is a joint tenancy? A joint tenancy request is when a sole tenant requests for another person to be added to their tenancy agreement. This means the other party takes joint responsibility and has equal rights to the tenancy and conditions, including rent.

Who will be considered? We will consider joint tenancy applications from married couples, civil partners and couples living as partners, including same sex partners. 
We will not consider applications where there are outstanding housing related debts, a history of ant-social behaviour, a current court order associated with a broken tenancy obligation, or a residency requirement is not satisfied.

What proof needs to be provided for the proposed joint tenant? The proof we require includes

  • one proof of identity including date of birth, for example a passport, driving licence, birth certificate or home office papers
  • one proof of address, for example a utility bill or bank statement
  • married couples and civil partners must provide a copy of their marriage or civil partnership certificate
  • long-term partners (not spouses or civil partners) must provide proof that they have lived together for at least 12 months

What eligibility checks will be complete on the proposed joint tenant? To confirm eligibility, we will check the following

  • are they currently or have they been a tenant with the council, a housing association or private landlord
  • do they own a property or land in the UK or abroad
  • are they or someone they are related to or associated with work for SMBC as an employee or councillor
  • immigration status
  • details of income
  • unsuitable behaviour i.e. anti-social behaviour, arrears or fraud

What is the interview for? The interview is important as we need to ensure that neither party are being coerced into becoming joint tenants.

What happens if the request is approved? When all checks have been complete, and the request has been approved both tenants will sign a new tenancy agreement.

What happens if I change my mind? If you change your mind during the process you should notify the officer dealing with your request in writing so that it can be cancelled. However, if you change your mind after the request has been finalised you will be required to apply for a sole tenancy.
